The Code on Administrative Offenses of the Republic of Belarus establishes liability for the illegal transfer of genetic resources outside the Republic of Belarus
Amendments to the Code on Administrative Offenses of the Republic of Belarus, enforced by the Law of the Republic of Belarus “On Amendments to the Codes on Administrative Liability Issues” dated April 15, 2026, No. 138-З, entered into force on June 19, 2026.
Article 16.24 of the Code on Administrative Offenses has been supplemented with a new set of elements constituting an administrative offense – the illegal transfer of genetic resources outside the Republic of Belarus.
Fines for the illegal transfer of genetic resources are stipulated:
• For individuals – from 20 to 30 basic amounts
• For individual entrepreneurs – from 20 to 200 basic amounts
• For legal entities – from 20 to 1000 basic amounts, with or without confiscation of the subject of the offense.
Please note that, in accordance with the Law of the Republic of Belarus “On Genetic Resources Management” and other by-laws, access to genetic resources for use outside the Republic of Belarus is provided by the National Coordination Centre on Access to Genetic Resources and Benefit-Sharing as part of the administrative procedure 6.28.5.
