Intellectual Property in the Context of Access to Genetic Resources and the Fair and Equitable Sharing of Benefits Arising from Their Utilization.

In this article, the author investigates the international and national legal framework regulating access to genetic resources and the fair and equitable sharing of benefits arising from their utilization. The concepts of “genetic resources”, “utilization of genetic resources”, “genetic resources management”, “provider and user of genetic resources” (GRs provider and user), and the protection of intellectual property rights in the use of objects deriving from genetic resources are systematized. Based on the study conducted, a number of recommendations have been formulated, in particular, on accession by the Republic of Belarus to the International Treaty on Plant Genetic Resources for Food and Agriculture and the WIPO Treaty on Intellectual Property, Genetic Resources and Associated Traditional Knowledge.
