Checkpoint for monitoring the utilization of genetic resources of the Republic of Belarus

On March 9, 2025, the Law “On Genetic Resources Management” came into force. The Law was adopted in the furtherance of the Nagoya Protocol on Access to Genetic Resources and the Fair and Equitable Sharing of Benefits Arising from Their Utilization to the Convention on Biological Diversity of October 29, 2010, and establishes legal bases for state regulation in the field of genetic resources and/or associated traditional knowledge management for the purpose of their preservation and the fair and equitable sharing of benefits arising from their utilization to ensure the conservation and sustainable use of biological diversity, the preservation of human health and the provision of food security.

On January 9, 2026, the Decree of the President of the Republic of Belarus “On Administrative Procedures Implemented by Government Bodies and Other Organizations Upon Applications of Citizens” was amended with regard to the list of administrative procedures (the Decree of the President of the Republic of Belarus No. 5):

Chapter 16 “Nature Management” was supplemented with clauses 16.8. and 16.9. stipulating administrative procedures for obtaining access to genetic resources (clause 16.8.) and changing genetic resources access terms (clause 16.9.).

In accordance with clause 16.8, the fee charged for obtaining access to genetic resources is 2 basic amounts, and in accordance with clause 16.9, the fee charged for changing genetic resources access terms is 1 basic amount.
